GENERAL TERMS AND CONDITIONS – INSTANT INSULATION
These General Terms and Conditions form an integral part of any estimate, quotation, invoice, or contract issued by Instant Insulation (hereinafter referred to as the “Contractor”).
By accepting an estimate or paying a deposit, the client acknowledges having read and agreed to these Terms and Conditions.
1. Scope of Work
Only the work specifically described in the estimate is included.
Any work not explicitly mentioned shall be considered additional work and will be subject to additional charges.
2. Measurements and Price Adjustment
When measurements are provided by the client (remote sale or online estimate), pricing is based on the information submitted.
The final price will be confirmed on-site based on:
Exact measurements
Actual accessibility
Structural conditions
Building characteristics
Any variation in surface area, configuration, or technical conditions may result in a price adjustment before work begins.
The Contractor reserves the right to suspend work if the client refuses the required adjustment.
3. Hidden Conditions
Any condition not visible during the estimation process may result in additional charges, including but not limited to:
Mold
Excess moisture
Poor ventilation
Presence of asbestos
Pest infestation
Structural damage
Hidden obstructions
Such work will require client approval before execution.
4. Building Code Compliance
Unless otherwise specified in writing, the client is responsible for:
Any required thermal barriers
Any fire protection requirements
Interior finishes (e.g., drywall, paint, etc.)
Any specific municipal or regulatory requirements
The Contractor is not responsible for regulatory requirements not explicitly included in the estimate.
5. Spray Foam Insulation
The client acknowledges that:
Spray foam thickness may vary slightly depending on weather conditions and surface characteristics
Thermal performance depends on several factors beyond the Contractor’s control
Any required protective or thermal barrier remains the client’s responsibility unless explicitly stated otherwise
6. Ventilation and Condensation
The Contractor is not responsible for:
Pre-existing ventilation issues
Condensation problems
Ice formation
Pre-existing mold
Existing structural defects
Work performed does not constitute a guarantee of the building's ventilation system.
7. Access to the Worksite
The client must:
Provide safe and unobstructed access to the work area
Clear the work zones
Remove or adequately protect personal belongings
The Contractor cannot be held responsible for damage to items not removed or insufficiently protected.
Additional fees may apply if the site is obstructed or improperly prepared.
8. Deposit, Payment, and Financing
A deposit may be required to reserve an installation date.
Unless otherwise specified:
The deposit confirms the client's commitment
The remaining balance is payable immediately upon completion of the work
Financing is subject to credit approval, and eligibility must be confirmed.
Promotional financing offers are limited in time, and Instant Insulation has no control over financing provider decisions.
Any unpaid balance will incur interest at 2% per month (24% annually).
9. Cancellation
Any cancellation within 72 hours of the scheduled installation date may result in the loss of the deposit.
If materials have already been ordered or costs incurred, those expenses remain billable to the client.
10. Government Rebates and Grants
Any information provided regarding government incentives or rebates is for informational purposes only.
The Contractor does not guarantee:
Client eligibility
Application approval
Processing timelines
The amount granted
Government rebates are paid directly to the applicant listed on the official program documents. The client is responsible for submitting their own application.
11. Warranty
The warranty covers labor only.
Materials are covered by the manufacturer’s warranty, subject to their respective terms and conditions.
Any warranty claim must be submitted in writing within 30 days of discovering the defect.
12. Delays and Force Majeure
The Contractor cannot be held responsible for delays caused by:
Weather conditions
Material shortages
Accidents
Labor disputes
Events beyond the Contractor’s control
Installation dates are approximate and not guaranteed.
13. Limitation of Liability
The Contractor’s maximum liability is limited to the amount paid for the work concerned.
The Contractor shall not be liable for:
Indirect losses
Loss of income or revenue
Consequential damages
Claims related to pre-existing conditions
14. Payment Disputes
Any payment dispute initiated without first contacting the Contractor will be considered a breach of contract.
Administrative and collection fees may be charged to the client.
15. Governing Law
This agreement is governed by the laws of the Province of Alberta.
Any dispute shall be submitted to the judicial district of Alberta.
